On September 2, 2020, Colorado state Attorney General Philip J. Weiser submitted a Petition for Waiver to the Federal Communications Commission requesting that the E-rate program restrictions on eligible locations be waived due to a nationwide shift to virtual learning environments.
Stating that the current program rules “disincentivize, and in some instances prohibit entirely, the use of E-Rate funds or E-Rate-funded facilities to extend schools’ broadband connectivity beyond physical campuses for educational purposes,” the State requests that the Commission waive the E-rate restriction limiting discounts to on-campus services as well as the “complex application procedures and competitive bidding requirements.”
