On December 20, 2018, the FCC denied Mansfield Independent School District (TX) their Order on Reconsideration Appeal and upheld USAC’s commitment adjustment based on competitive bidding violations. On Mansfield’s Form 470, USAC found that they failed to “…specify the services it requested with sufficient specificity…” The FCC concurred and stated that service providers could not “….reasonably determine the school district’s needs….that a bona fide request for E-rate services means that applicants must submit a list of specified services for which they anticipate they are likely to seek discounts consistent with their technology plans, in order to provide potential bidders sufficient information….
