FCC Releases February Appeal Decisions

On February 27, 2017, the Federal Communications Commission (FCC) released several appeal decisions related to the requests for review, requests for waiver, and petitions for reconsideration of E-rate beneficiaries. The FCC dismissed 24 requests, granted 5 and denied 24 appeals on various grounds.
Successful Appeals were tied to:
  • Granted on Reconsideration – Waiver of Price as Primary Factor Requirement: Applicant Selected Lowest-Price Solution
  • No Service Provider Involvement in Competitive Bidding Process
  • Waiver of Appeal Filing Deadline
  • Waiver of Price as Primary Factor Requirement: Applicant Selected Lowest-price Solution
Appeals involving the issues listed below were denied:
  • Failure to Conduct a Fair and Open Competitive Bidding Process
  • Violation of the Competitive Bidding 28-Day Rule
  • Invoice Deadline Extension Requests
  • Late-Filed FCC Form 471 Applications
