On June 30, 2015, the FCC released several appeal decisions related to the E-rate program. The FCC granted 27 appeals and waivers, while denying 25 appeals.
Successful appeals and waiver requests dealt with the following issues:
- Late-Filed FCC Form 471 applications filed within 14 days of the close of the window
- Late Filed FCC Form 471 applications – circumstances beyond applicant’s control
- Violation of the 28-Day competitive bidding requirement
- Providing applicants 15 days to submit supporting discount calculation documentation
Appeals were denied regarding the following issues:
- Failure to consider price as the primary factor in vendor selection process
- Invoice Deadline Extension Requests
- Late filed FCC Form 471 application
- Violation of the 28-Day competitive bidding requirement
