On May 29, 2015, the FCC released several appeal decisions related to the E-rate program. The FCC granted 40 appeals and waivers, while denying 11 appeals.
Successful appeals and waiver requests dealt with the following issues:
- Allowing deduction of ineligible costs
- Eligible services
- Granting additional time to respond to usac’s request for information
- Granting late filed service implementation deadline extension requests
- Late filed FCC Form 471 application filed within 14 days of close of the window
- Record demonstrates equipment delivered within funding year
- Ministerial and/or clerical errors
- Providing applicants 15 days to submit supporting discount calculation documentation
Appeals were denied regarding the following issues:
- Ineligible entities
- Intentional cancellation of funding
- Late filed form 471 applications
- Relying on an FCC Form 470 that did not seek bids on types of E-rate services later requested
- Untimely filed request for review
