On April 29, 2015 the FCC released several appeal decisions related to the E-rate program. The FCC granted 23 appeals and waivers while denying 7 stakeholder appeals.
The successful appeals and waiver requests had to do with the following issues:
- Cost Effectiveness Review
- Early installation
- Eligible services
- Late filed form 471 Item 21 Attachments
- Late filed Form 471 Applications
- Ministerial or clerical errors
- Service substitutions
- Signed contract requirements
- Service implementation deadline extension requests filed late
- Violation of competitive bidding 28 day bidding rule
The appeals denied had to do with the following issues:
- Service implementation deadline extension requests filed late
- Untimely filed appeals request for review
- Violation of competitive bidding 28 day bidding rule
